ORDINANCE NO. 9426 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE FOUR TRACTS OF LAND LOCATED AT 534 VINE STREET, 800 OAK STREET, AND IN THE 500 BLOCK OF MCCALLIE AVENUE, BEING ON THE SOUTHWEST LINE OF VINE STREET NORTHWEST OF DOUGLAS STREET, THE SOUTHWEST LINE OF OAK STREET AT PALMETTO STREET, AND THE NORTHEAST LINE OF MCCALLIE AVENUE NORTHWEST OF DOUGLAS STREET FROM R-3 RESIDENTIAL ZONE, C-2 CONVENIENCE COMMERCIAL DISTRICT AND C-3 CENTRAL BUSINESS DISTRICT TO R-4 SPECIAL ZONE. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: Four tracts of land located at 534 Vine Street, 800 Oak Street, and in the 500 block of McCallie Avenue, being on the southwest line of Vine Street northwest of Douglas Street, the southwest line of Oak Street at Palmetto Street, and the northeast line of McCallie Avenue northwest of Douglas Street. Tract 1 (534 Vine Street): The east 10 feet of lot 20, the west 70 feet of lot 22, the east 10 feet of the north 75 feet of lot 19, and the west 70 feet of the north 75 feet of lot 21, block E, Long's Addition to Chattanooga, not recorded, and lots 1-7, Hickman's Subdivision of the J.T. Thomasson and Atwell Thompson Lots in Block "E", Long's Addition to Chattanooga, as shown by plat of record in plat book 5, page 70, R.O.H.C. Said lots and parts of lots form one tract beginning at the intersection of the southwest line of Vine Street, thence with Mable Street southwest 255 feet, and southeast 28 feet to the southeast corner of lot 7, said Hickman's Subdivision, thence northwest 160 feet with the southwest line of lot 7, and said line extended, thence northeast 275 feet parallel to, and at all points 10 feet northwest of, the southeast line of lots 19 and 20, block E, said Long's Addition, to the southwest line of Vine Street, thence southeast 140 feet with Vine Street to the northwest line of Mable Street, the point of beginning. The east 10 feet of lots 19 and 20, block E, said Long's Addition, is shown as an alleyway in the C.W. Chadwick and the J.M. Smedley plat books of Chattanooga, and appears to be shown as an alleyway on the Hunnicutt Tax Maps. Tract 2 (the 500 block of McCallie Avenue): Part of lot 26, block H, Long's Addition to Chattanooga, not recorded. Said part of lot begins on the northeast line of McCallie Avenue 90 feet northwest of the intersection of the northeast line of McCallie Avenue with the northwest line of Douglas Street, thence northwest 90 feet with McCallie Avenue to the southwest corner of said lot 26, thence northeast 150 feet with the northwest line of said lot, thence southeast at a right angle 45 feet, thence northeast 50 feet parallel to the northwest line of said lot 26, thence southeast at a right angle 45 feet to the southeast line of said lot, thence southwest 200 feet with said southeast line to the northeast line of McCallie Avenue, the point of beginning. Tract 3 (517, 525 and 531 McCallie Avenue): Part of lots 18, 20, and 22, block H, Long's Addition to Chattanooga, not recorded. Said parts of lots form one tract beginning on the northeast line of McCallie Avenue 280 feet northwest of the intersection of the northeast line of McCallie Avenue with the northwest line of Douglas Street, thence northwest some 302 feet with McCallie Avenue to the southwest corner of said lot 18, thence northeast 150 feet with the northwest line of said lot 18, thence southeast 100 feet to a point in the southeast line of said lot 150 feet northeast of the southeast corner of said lot, thence northeast 10 feet with the southeast line to said lot 18, thence southeast 100 feet to a point in the southeast line of lot 20, said point being 160 feet northeast of the southeast corner of said lot 20, thence southwest 10 feet with the southeast line of lot 20, thence southeast at a right angle some 43.58 feet, thence northeast 18 feet, thence southeast at a right angle 58.5 feet to a point in the southeast line of lot 22, thence southwest 168 feet with said lot line to the northeast line of McCallie Avenue, the point of beginning. Tract 4 (800 Oak Street): The north 108 feet of lot 19, block 2, Fort Wood Addition to Chattanooga, as shown by plat of record in plat book 1, page 4, R.O.H.C. Said part of lot begins at the intersection of the southwest line of Oak Street with the southeast line of Palmetto Street, fronts 50 feet on Oak Street, and extends southwest 108 feet between parallel lines, the northwest line of said tract being the southeast line of Palmetto Street. from R-3 Residential Zone, C-2 Convenience Commercial District and C-3 Central Business District to R-4 Special Zone. SECTION 2. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
